Welcome to Design Inc, a luxury interior design and home improvement company based in Palm Beach County, Florida. These Terms and Conditions (“Terms”) govern your access to and use of our website and services. By using our website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you should not use our services or this site.

Please read these Terms carefully before using any part of our website or engaging our services.

1. About Design Inc

Design Inc has proudly served homeowners and developers for over 15 years, offering full-scale interior design, remodeling, model merchandising, CAD services, and logistics support. With a team of 70+ experts, including more than 20 certified interior designers, we operate with a fully integrated model, from concept to delivery.

These Terms apply to all users of our site and clients using our services, including boutique purchases, design consultations, remodeling contracts, or CAD-related requests.

2. Website Usage

Design Inc grants you a limited, non-exclusive, non-transferable license to access and use the site for informational and service-related purposes only.

You agree not to:

  • Use the website for any fraudulent or unlawful purpose.
  • Upload or transmit viruses or malicious code.
  • Scrape, copy, or reuse any content without permission.
  • Interfere with the functionality or security of the website.

We reserve the right to suspend or terminate access for users who violate these terms.

3. Intellectual Property

All website content, including text, images, graphics, icons, videos, software, and layout, is the intellectual property of Design Inc or its licensed partners. You may not reproduce, distribute, modify, or republish any part of the site without written consent.

Our company name, logo, and branding elements are protected trademarks. Use of our trademarks without permission is strictly prohibited.

4. Service Terms

Design Inc offers the following core services:

  • Interior Design & Space Planning
  • Remodeling & General Contracting
  • Model Home Merchandising
  • CAD Drafting & Visualization
  • Warehousing & White-Glove Delivery
  • Boutique Product Sales

All service engagements are subject to a written agreement that outlines project scope, design fees, deliverables, and timelines. Work will not commence until both parties have signed this agreement.

5. Consultations & Estimates

We provide free consultations for prospective clients, either in our showroom or at your property. Project estimates are based on initial design scope and may be subject to change after in-depth measurements, client revisions, or structural discoveries during construction.

Missed or canceled consultations without at least 24-hour notice may require rescheduling and could incur a consultation fee.

6. Payment Policy

Payment terms will be clearly defined in the client agreement and may include:

  • Initial Deposit (typically required before design begins)
  • Progress Payments (based on project milestones)
  • Final Payment (upon completion or delivery)

We accept payment via check, major credit cards, wire transfer, and approved digital payment systems. Late payments may delay work and incur a late fee of 1.5% per month.

Design Inc reserves the right to pause any project or delivery if payments are not made on time.

7. Refunds & Cancellations

Because our work is highly customized, most design services and boutique product sales are non-refundable once a project begins or an item is ordered.

Design Services:

Cancellations before concept development may be eligible for partial refunds, excluding administrative costs. No refunds will be issued after CAD work, purchasing, or remodeling has started.

Boutique Products:

All boutique items are final sale unless damaged during shipping. Damage must be reported within 48 hours of receipt, with images.

Custom Orders:

Custom furnishings, finishes, or installations are non-refundable once production or ordering has begun.

8. Timeline & Delays

Design Inc makes every effort to complete projects on schedule. However, timelines may be affected by:

  • Client delays in approvals or payments.
  • Product backorders or manufacturer delays.
  • Unforeseen site conditions (plumbing, electrical, structural issues).
  • Weather or force majeure events.

We will communicate any potential delays and adjust the schedule as needed. Design Inc is not liable for project timeline extensions caused by external vendors or supply chain disruptions.

9. Use of Third Parties

We partner with a network of trusted third-party vendors, subcontractors, and product suppliers. While we aim to ensure top-quality service, Design Inc is not liable for third-party errors, defects, or delays.

Any manufacturer warranties or claims related to third-party goods must be pursued directly with the vendor.

10. Delivery and Installation

Design Inc operates a three-story warehouse and a private delivery fleet to manage logistics efficiently. Delivery timelines will be coordinated with clients during the project planning phase.

Our white-glove delivery includes inspection, assembly, and professional placement. Clients are responsible for ensuring accessibility to the delivery site and must notify us in advance of any access limitations.

11. Design Ownership & Usage

All design plans, CAD drawings, mood boards, color palettes, and visual assets remain the property of Design Inc until the project is fully paid and complete. Clients may not reproduce or share these materials with other contractors or design firms.

Unauthorized use or duplication of our design work without written consent is a breach of this agreement and may result in legal action.

12. Client Responsibilities

As a client, you are responsible for:

  • Providing accurate property information.
  • Responding to communications and approvals promptly.
  • Making timely payments.
  • Maintaining access to the property during remodeling or delivery.
  • Communicating any changes or concerns immediately.

Failure to meet these responsibilities may result in project delays, additional fees, or cancellation.

13. Limitation of Liability

Design Inc is not liable for any indirect, incidental, or consequential damages resulting from:

  • Delays in project delivery.
  • Loss of property value.
  • Design dissatisfaction after execution.
  • Third-party vendor issues.
  • Use or misuse of products purchased through our boutique.

In all cases, our liability is limited to the amount paid by the client under the specific project agreement.

14. Indemnification

By using our website or services, you agree to indemnify and hold harmless Design Inc, its employees, directors, and affiliates from any claims, damages, losses, or legal fees arising from:

  • Your breach of these Terms.
  • Unauthorized use of our services or designs.
  • Any negligent or unlawful conduct related to our site or services.

15. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to learn how we collect, use, and store your personal information.

We do not share your data with third parties without your consent, except when required to complete a project or comply with legal obligations.

16. Modifications to Terms

Design Inc may update these Terms at any time without prior notice. Updated Terms will be posted on this page with the new effective date.

Your continued use of our website and services after such changes constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising under or related to these Terms or our services must be resolved in the courts of Palm Beach County, Florida.
